You acknowledge that:

​

  • you are over 18 years of age;

​​

  • you understand that the classes are a form of physical activity and that there are inherent risks in undertaking any form of physical exercise; you are participating entirely at your own risk, and that you assume all risks of injury, illness or death.

​​

  • you have disclosed, or will disclose to the Instructor prior to the class commencing, any pre-existing conditions that may place you at a higher risk of injury or inhibit your ability to participate in a class, this includes, but is not limited to:

    • injuries, pain or recent surgery (within 6 months);

    • pregnancy or if you have recently given birth; or

    • respiratory or heart conditions or high blood pressure

    • osteoporosis

  • you will notify the Instructor if you experience any excessive pain throughout the class and will immediately stop participating in the class if requested by the Instructor to do so;

​​

  • based on information you provide, the Instructor may decide not to allow you to participate in a class, or may require you to provide a medical certificate affirming that you are able to participate in a class before allowing you to join, in the Instructor’s sole discretion;

​​

  • in group classes, recommendations or instruction provided by the Instructor may tailor for particular skill or ability level by giving options, and it is your responsibility to assess whether you are able or want to participate in all or part of the class;

​​

  • you are solely responsible for ensuring that your physical environment is suitable for your participation in any class;

  • Classes or workshops may be recorded or photographed by the Instructor for quality control, as well as promotional purposes. I grant permission to Summit Pilates, the rights of my image, in video or still, and of the likeness and sound of my voice as recorded on audio or videotape. I understand that my image may be edited, copied, exhibited, published, or distributed, and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area. By signing this release, I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public educational setting. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. By signing this release, I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organisation utilising this material for educational purposes. If you do not wish your image to be used, please advise as such to Summit Pilates in writing (not text) prior to your first class.

To the extent permitted at law, you release and hold the Instructor (and where applicable its, directors, employees and representatives) harmless from any liability, cost, expense, damages or claims (including claims of negligence) arising from or which may be suffered or incurred in connection with your participation in any classes provided by the Instructor.

Please read the following terms carefully. By participating in any class or workshop provided by Summit Pilates, ABN 91729736718 (the Instructor) you consent to, and agree to release the Instructor from liability according to, these terms. Unless the Instructor notifies you otherwise, this waiver and release will apply to all classes undertaken by you with the Instructor.

Terms & Conditions

When you purchase or book classes or courses through Summit Pilates, or purchase or rent a vidoo on the viseo library, you agree to this Terms of Use and Liability Waiver. 
 
Summit Pilates is intended solely for Users who are at least 18 years of age or older. While minors may be invited to move with caregivers, accessing the site and its materials requires adult supervision. Any use of or access to Summit Pilates by anyone under such is unauthorised, unlicensed, and in violation of these Terms of Use. By purchasing classes or courses through Summit Pilates, you represent and warrant that you are 18 years or older and that you agree to and to abide by all of the terms and conditions of this Agreement.
 
Attendees of online classes and courses acknowledge that attendance to Summit Pilates requires internet access. Summit Pilates is not responsible for the quality of the Customer’s internet connection for the day of class/course.

 

Attendees of online classes, on-demand videos, and courses are solely responsible for ensuring that your physical environment is suitable for your participation in class, and free of hazards. 
 
The supplies and props used for any exercises instructed are not included in the purchasing price of the Summit Pilates class. 

 

Whether attending in person or online, you agree to treat the Instructor and all other participants with respect.  No offensive or derogatory language will be accepted, and the Instructor has the right to terminate your attendance in class, whether in person or online, if it is considered that such commends are made.  This is at the sole discretion of the Instructor.

 
The copying, redistribution, use, or publication by you of any of the content within summitpilates.com.au or classes or courses run by Summit Pilates is strictly prohibited unless otherwise directed.

Memberships & Cancellation periods:

 

  1. All sales are final for Summit Pilates. No refunds are issued for Summit Pilates once a sale is completed. 

  2. If you book but do not attend you will be deducted the session as if you had attended.

  3. Any Summit Pilates membership plan consists of monthly payments to Summit Pilates and is debited from a credit card or direct debited from your bank account. We only accept VISA & MasterCard cards.  If on a membership, you must keep a current credit card stored in your account on the website for the monthly payments, or late fees. If your credit card is not current, your membership may be suspended.

  4. Your contract consists of the allocated number of sessions per week and these will be provided to you, in total, at the start of each contracted period. The sessions for each contract period have an expiry as listed on the website. If you have not used all of the sessions during the set period they will be forfeited.

  5. Unfortunately, this means we cannot refund any purchases and all monthly accounts payments will need to be made in full, including if you did not use all of your sessions.

  6. Any set-month membership plan must be paid for in advance for the month – there are no cooling off periods, early terminations or refunds or credits given.

  7. Memberships can be suspended due to holidays or illness, for a maximum of a 2 week period in any 3 month period,  You must make application prior to the time period requested for suspension, as memberships can be suspended retrospectively.   During suspension, you will be unable to book classes and when you return your account will be automatically adjusted in terms of the payment amount and the duration of your contract. 

  8. Your monthly payments may sometimes decline because of card problems, security reasons or funding issues. If this occurs, we will apply a small fee of $15.00 to your next payment to cover the costs of resolving the payment decline. Unfortunately, these are the charges incurred by Summit Pilates from the credit card processing merchants and these cannot be absorbed by Summit Pilates.

  9. Membership plans will automatically be renewed at the end of the membership plan period. The details of your renewed membership plan will reappear when you log in and will need to be re-confirmed. Renewed membership plans have the same terms and conditions applied as the original membership period, including all cancellation policies and fees.

  10. Membership plans can be upgraded at any time 

  11. Session purchases including casual, 10 class and 20 class passes all have relevant expiry periods. For the specific expiry date of your session purchase please check your account. It is your responsibility to be aware of the expiry date of any/all of your session purchases and Summit Pilates does not take any responsibility for managing your expiry dates and is not under any obligation to provide you with notice of any session purchase expiry.

  12. Only under extreme cases will Summit Pilates provide an extension to session purchase expiry dates. Summit Pilates reserves the right to deny any request for extension.

  13. If you cancel a group class within 6 hours of that class being scheduled, this will be considered a ‘late cancel’ and that session will still be deducted from your membership plan or class pass.  

  14. If you cancel a studio/clinical class within 12 hours of that class being scheduled, this will be considered a ‘late cancel’ and that session will still be deducted from your membership plan/class pass.

  15. Cancellation window for late cancel to Instructor Workshops is 48 hrs. 

  16. Workshop tickets are non-refundable, should you early cancel or be unable to attend an in-person workshop (with at least 48hrs notice), you will receive a credit to the same amount of your payment towards another workshop.  The credit is valid for 6 months from the Workshop date.

  17. If you book a class and fail to attend, that session will still be deducted from your membership plan/class pass.

  18. If you fail to confirm or deny a position on a wait list, it will be like you have attended the class and the session will be deducted from either your membership or your session purchase. It is your responsibility to ensure your account notifications are active.

  19. Summit Pilates will not extend your contract further for you not being able to available class times if you have not forward booked.

  20. Sessions can be booked 90 days in advance. For further advanced bookings you will need to contact the office. Advance bookings greater than 60 days are at the discretion of Summit Pilates.

  21. Summit Pilates may cancel a class at any time and for any reason or may make changes to the timetable without prior notification to any client or member. Summit Pilates will credit any classes they cancel back to your membership or session purchase. If you are already booked for a class that is cancelled you will be notified by text &/or email.

  22. Summit Pilates reserves the right to change or substitute any instructor, at any time without providing notice to you. Summit Pilates will not credit classes back to your membership or session purchase due to change or substitution of an instructor.

  23. Summit Pilates may close for Christmas, Easter, other Public Holidays or any other day at the discretion of Summit Pilates.

  24. Terms and Conditions may be adjusted without notice at any time due to operational requirements.  You may view the latest updates any time via the link in the Summit Pilates Website Footer.

  25. By proceeding with a purchase or booking, you are confirming that you have read and understood the Terms and Conditions.

Privacy Policy

Using personal information
Summit Pilates may use your personal information to: administer this website; personalise the website for you; enable your access to and, use of the website services; send to you products that you purchase; supply to you services that you purchase; send you statements and invoices; collect payments from you and send you marketing communications. Where Summit Pilates discloses your personal information to its agents or sub-contractors for these purposes, the agent or sub-contractor in question will be obligated to use that personal information in accordance with the terms of this privacy statement. In addition to the disclosures reasonably necessary for the purposes identified elsewhere above, Summit Pilates may disclose your personal information to the extent that it is required to do so by law, in connection with any legal proceedings or prospective legal proceedings, and in order to establish, exercise or defend its legal rights. 


Securing your data

Summit Pilates will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. Summit Pilates will store all the personal information you provide on its secure servers. Information relating to electronic transactions, including credit card details, entered via this website will be protected by encryption technology.

 
Cross-border data transfers

Information that Summit Pilates collects may be stored and processed in, and transferred between any of the countries in which Summit Pilates operates to enable the use of the information in accordance with this privacy policy. You agree to such cross-border transfers of personal information.
